TERMS AND CONDITIONS


BEFORE USING THIS WEB SITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Introduction:

These terms and conditions govern visitors' access to and use of the web site, and the supply of products ordered via the website. Wine Odyssey Pty Ltd may modify or repeal these terms and conditions without prior notice. In case of a modification or repeal, the pre-existing terms and conditions continue to apply to any products ordered via the web site before the change takes effect.

By completing the customer registration process and using the wineodyssey.com.au service, you acknowledge that you have read and understood these terms and conditions and agree to be bound by the terms and conditions of this Agreement.

Supply of products:


Buyers:
To buy wine via the web site, the buyer must be at least 18 years of age, be located within Australia and specify a delivery address within Australia.

Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age. The courier will request some form of ID if there is any doubt about the age of the recipient on delivery. If that recipient is unable to produce appropriate ID, the courier cannot leave the wine.

Special offers:
At any time, Wine Odyssey may terminate any special offer without advance notice.

Prices:
Prices stated are in Australian dollars, and may be per bottle or per case, as stated. Prices include GST, unless otherwise stated. All delivery charges are extra, and not included in stated prices.

Payment:
A buyer must pay for an order by Visa or MasterCard when ordering. If the credit card issuer does not authorise the transaction, or later revokes authorisation for the transaction, Wine Odyssey may cancel the order.

Pricing errors:
If a product inadvertently appears on the web site at the wrong price, Wine Odyssey may decline or cancel any orders placed at the wrong price, even if the order has been confirmed and a credit card charged. If a credit card was charged for the purchase and the order is so cancelled, Wine Odyssey will notify the buyer and issue a credit to the credit card account in the amount of the wrong price.

Product availability:
Wine Odyssey will use its best endeavours to ensure that all products ordered by you are supplied to you. All product is offered for sale on the basis of while stocks last. If a product is out of stock, Wine Odyssey will notify you within two days and assist you in substituting wines of at least equal quality and value; if this is not possible Wine Odyssey will refund your money in full.

Delivery:
General delivery turnaround times are only a couple of days for major metro areas. However, please allow up to 5 working days for delivery. In outlying areas, delivery will be may take a little longer. Wine Odyssey do not however guarantee any specific delivery date.

Please provide a Business Hours address and contact details. Otherwise, please provide special delivery instructions if no one is home. If the premises are unattended, the wine will not be left but rather the driver will leave a card and the wine will be delivered to your nearest Post Office.

Drivers will not telephone before delivery.

Breakages:
If a case of wine is received with one or more broken bottles, Wine Odyssey will issue a credit or send replacement bottles if the buyer so notifies Wine Odyssey within 30 days of the date of the invoice.

Risk:
Risk of damage, loss or deterioration to product passes to the buyer on delivery.

Title:
Product remains Wine Odyssey's property until paid for by the buyer.

Customer Promise:
A buyer of wine via the web site who does not like a particular bottle supplied (within 6 months of the sale) need only notify Wine Odyssey as soon as possible to obtain a refund of the price of that bottle. Wine Odyssey will then advise if the wine is also to be collected from the buyer.

If a case of wine was purchased, and the buyer has only opened one bottle and not liked it, they need only notify Wine Odyssey and be able to make the remaining bottles available for collection (unopened and in original saleable condition) to obtain a refund of the price of the whole case.

If Wine Odyssey reasonably believe that a buyer has breached these terms and conditions, or has abused the Customer Promise, Wine Odyssey may suspend or cancel the Customer Promise in relation to that buyer, cancel a particular order made by the buyer or close that buyer's account.

Cancellations:
A buyer may for any reason cancel their order at any time up to 7 working days after the date the wine is received by so notifying Wine Odyssey and provided the bottles are unopened and in original saleable condition.

Returns:
Where wine is to be returned, Wine Odyssey will collect the wine from the buyer at a mutually convenient time. Pending collection, the buyer is liable to keep the wine in a safe and proper manner and take reasonable care of it. Wine should be returned in the original box and packed to avoid breakage in transit back to Wine Odyssey.

Refunds:
Any price refunds will be affected within 30 days after Wine Odyssey was notified of the reason, conditional upon any returned wine being collected in original saleable condition.

Product warranties:
Wine Odyssey warrants that product supplied is of merchantable quality when delivered. Subject to applicable law, Wine Odyssey does not make any other warranty or representation about products on offer. In respect of any statutory warranty that Wine Odyssey cannot exclude, subject to applicable law, Wine Odyssey’s liability is limited, at its option, to the replacement or re-supply of the products or a refund of the cost of the products.

Specials and promotions:
All specials, promotions, clearances, offers and discounted items advertised on the Wine Odyssey web site are available only while stocks last unless otherwise advertised. All terms and conditions of specials, promotions, clearances, offers and discounted items advertised on the Wine Odyssey web site shall apply. Promotions not available in all areas.

Material displayed on the web site is subject to copyright owned by Wine Odyssey or its content suppliers and is protected by law. Brands and logos displayed on the web site may be the subject of registered trademarks of Wine Odyssey or its product suppliers and protected by law.

Third-party Links:
If the website links to another website, Wine Odyssey is not responsible for the content of these web sites, nor for any use (or misuse) of information a visitor may supply to that other web site, nor for any goods or services on offer at that other web site. If a visitor has a problem with a third party website, please notify Wine Odyssey.

Third-party content:
If the web site displays material sourced from a third party (including a supplier of product, or a consumer of product), Wine Odyssey does not warrant or represent the accuracy, utility or other characteristic of that material.

Indemnity:
A visitor agrees to indemnify, defend, and hold harmless each of Wine Odyssey, its officers, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs resulting from any violation of these terms and conditions or any activity related to the visitor's account (including negligent or wrongful conduct) by the visitor or any other person accessing the web site using the visitor's Internet account.

Web site functionality:
Wine Odyssey does not represent or warrant that the functions within the web site would be uninterrupted or error-free, that any defects would be corrected, or that the web site or the server that makes the web site available is free of viruses or other harmful elements. Of course, we do the best we can guarantee this.

Password security:
A visitor to the web site allocated a password is responsible to prevent the password being disclosed to any third party. You agree to take responsibility for the safekeeping of your PIN or password. You are liable if an unauthorised person uses your PIN or password. You agree to release and forever indemnify Wine Odyssey in relation to any liability howsoever arising out of the unauthorised use of your PIN or password.

Privacy and security:
Visitors' privacy is important to Wine Odyssey, and Wine Odyssey deploys encryption and other technology with the aim of protecting credit card information and the customer database. Access to this database within Wine Odyssey is restricted. Wine Odyssey does not sell, rent, trade or rent personal information. By providing their details to Wine Odyssey on the web site, a visitor consents to Wine Odyssey maintaining, recording, holding and using that information to process their orders, to improve the service to customers and to inform the visitor of promotions. Wine Odyssey may give notice to you by electronic mail or by regular mail to your address contained in the registration information provided by you. Governing laws:
The laws in New South Wales govern the use of the web site and the supply of products.

Force majeure:
Wine Odyssey is excused from performing its supply obligations where and so long as prevented from doing so by reason of events beyond its reasonable control. Wine Odyssey will endeavour to notify the buyer of the delay and its expected duration. If so prevented for longer than a reasonable time, Wine Odyssey may elect to cancel the order without liability to the buyer.

Cautions:
Wine Odyssey recommends that alcohol only be consumed in moderation. A case of wine is heavy, so extra care should be taken when lifting it. If you are concerned about the weight, transfer bottles 1 or 2 at a time. Red wine in particular may cause staining if spilt.
